    I, PHOTIUS COUTSOUKIS, being first duly sworn, depose and state:

    Following is the transcript of an excerpt from my telephone conversation with Marc Domicello, attorney for the Petitioner, which took place on February 17, 1999, also entirely available on audio tape, headed (barring recusal) for my judicial conduct commission package. ....

    Mr. Coutsoukis: I also don�t believe you have to reply to my recusal thing.

    Mr. Domicello: I do. I was directed to.

    Mr. Coutsoukis: Ya, but you called her and asked.

    Mr. Domicello: No, I was there in court. She told me to.

    Mr. Coutsoukis: You went to court?

    Mr. Domicello: I was there on something else.

    Mr. Coutsoukis: And what happened?

    Mr. Domicello: I was told to do it.

    Mr. Coutsoukis: She said, "by the way, I want you to answer this"?

    Mr. Domicello: "Did you see the recusal thing?"

    Mr. Coutsoukis: Ya?

    Mr. Domicello: "Well, answer it."

    Mr. Coutsoukis: That�s ex parte
